The issue in this case is whether the indefinite retention of fingerprints, photographs, DNA samples and DNA profiles of an individual convicted in Northern Ireland of a recordable offence is (i) an interference with the rights protected by Article 8(1) ECHR and (ii) if so, justified in accordance with Article 8(2) ECHR.
The Supreme Court dismisses the appeal by a majority of 4:1.
