The case came up for trial. My client suffered significant injury as a result of improperly performed foot surgery. During jury selection I approached the defense attorney to try and negotiate the case.
I demanded $125,000 to settle this case. The defense attorney agreed this was the right number to settle this case. But there was a problem...
The doctor, a podiatrist, refused to negotiate.
In NY, there are some doctors who have insurance policies that give them control over whether or not they can decide whether to allow the attorney and their insurance company the ability to negotiate if they believe it is appropriate.
That means if the doctor refuses to negotiate, then the defense attorney and the insurance company cannot offer any money to negotiate- even if they feel the case should be settled.
If the doctor consents to settle, then negotiations can take place. However, if the doctor refuses to even consent to begin negotiations, then the defense attorney cannot offer a dime.
