In the course of the divorce, can my ex cancel my insurance? The answer is yes they can. Is it legal to do so? No, it is not legal. During the course of the divorce, there is such thing as maintenance. It means the obligations and the usual payments for anything are to continue. That includes insurance. If your ex-spouse or soon-to-be ex-spouse do so, it will be seen as bad faith by the court. Stopping payment of insurance is a violation of the maintenance order. Such bad faith as stopping payment for insurance will not sit well with the court. It will reflect in future proceedings. The party acting in bad faith can be held in contempt. The court will order the reinstatement of insurance. They can be penalized in the form of paying your attorney fees.
