What should I know about repeat DUI / OVI offenses in Ohio? I'm Shawn Dominy, I'm a DUI / OVI lawyer in Columbus, Ohio, and this video is going to answer that question.
What you should really know about repeat OVI offenses is things get worse with every time that you’re charged with OVI. There are mandatory sentences, and there are also discretionary sentences, and you need to be concerned about both of those.
Here’s what I mean by that. Let’s take a second offense OVI within 10 years. There’s a mandatory minimum jail sentence of 10 days, and there is a mandatory minimum license suspension of two years. Those have increased from a first offense, so they’ve gotten worse because it’s a second offense within 10 years. However, the discretionary part should also be a concern, because those are just the minimums. A judge can actually give you up to six months in jail, and a license suspension for up to 12 years on a second offense. It gets even worse for a third offense, and for a felony offense.
So, if you’ve been charged with any repeat offense, you should give serious thought to how you’re going to handle your case. If you went into court on your previous case and just pled guilty, you may want to look into things before you do that on a repeat offense, because the consequences are much more severe.
