Bodycam Footage From 09/03/2023 - Game Warden Amis and another officer were patrolling Norfork Lake when they observed a dark blue pontoon boat departing Float Creek and heading towards Robinson Point. A female individual was operating the vessel with a male individual seated beside her, who then stood up next to her. Upon noticing the patrol boat, they switched positions in operating the vessel, momentarily leaving the steering unattended. The boat did not display any registration stickers or numbers. The officers initiated blue lights and began following the boat. It took the female operator several hundred yards to stop the vessel. The officers approached the individuals and discussed the absence of registration and the reason for switching drivers. The individuals stated they had owned the vessel for about a year, had taken it out on the water multiple times, and were unaware of the requirement to display registration information. They explained that they switched drivers so the female could enjoy the view.
Upon approaching the individuals, the officers detected a strong odor of alcohol emanating from both of them. They inquired about their alcohol consumption, to which the female stated she had not consumed much, while the male initially claimed he had not consumed any. A preliminary breath test (PBT) administered to the female registered 0.045, while the PBT given to the male at 18:59 registered 0.17. The officers conducted a Horizontal Gaze Nystagmus (HGN) test on the male subject, which revealed distinct and sustained nystagmus at maximum deviation and prior to 45 degrees in both eyes.
Subsequently, the male subject was asked to retrieve his wallet and shoes and join the officers in their boat for further testing. They traveled to Robinson Point for Standardized Field Sobriety Testing (SFST). During the HGN portion of the SFST, the male subject exhibited lack of smooth pursuit in both eyes, sustained and distinct nystagmus in both eyes, and nystagmus onset prior to 45 degrees in both eyes. During the walk and turn test, the subject had difficulty maintaining balance during the instructional stage and stopped walking after the first step of the second set of steps, also making an incorrect turn at the end of the first nine steps. During the one-leg stand test, the subject put his foot down within the first 10 seconds.
At that point, the officers informed the male subject that he would be charged with Boating While Intoxicated (BWI) and would be transported to the Baxter County Jail for a blood alcohol content (BAC) test. Deputy Clay Maple transported the individuals to the Baxter County detention center. The male subject was read his statement of rights, and Deputy Maple conducted the BAC test, which returned a final result of 0.153 at 20:41. The male subject was issued a citation for BWI, inattentive operation, and improper number display, and was subsequently booked into jail.
