In this video Marc Whitehead, Board Certified Disability Insurance Lawyer, explains The Standard Insurance Company.
The Standard was founded in 1906, has now become and major seller of insurance products and a fortune 500 company. Selling group and individual disability insurance plans for short term and long term disability insurance coverage throughout the United States through its affiliated companies.
Large Insurance Companies are required to complete good faith review of applications for disability benefits. Meaning the Insurance Company is to remain impartial when evaluating claims, yet several insurance companies deny claims in bad faith as a way of containing costs and increasing the companies profits.
Sometimes instead of denying you the insurance companies will ask you for additional documents like medical records to avoid giving you an answer. Delaying the benefits you desperately need. It's important to know what you can do to fight back when your insurance is not playing fair with you.
Some reasons insurance companies give when denying a claim while some denials can be fair, they can also be availed and being used as an attempt to discourage claimants.
Common denial reasons include:
Disability not being supported by medical records
Disability not supported by objective evidence
Physical disabilities don't prevent you from completing tasks required by you previous occupation.
Often times insurance companies will use a boarder definition of disability, an own occupation definition therefore justifying their reason for denying the claim. Even though the claimant may be totally disabled.
If the Standard denies your benefits through your employers group disability plan. Lawsuits to appeal these denials are governed by federal ERISA law. Organization, Review and Timing are key components of ERISA claims.
Most Attorneys are unfamiliar with the complex process in ERISA law and how insurance companies may use ERISA to their advantage. The sooner you involve an Attorney experienced in ERISA the greater your chances of overturning their denial.
