Do daughters have equal rights in ancestral property?
"Ancestral Property" Meaning
Ancestral property is a property inherited by a Hindu family from their father, grandfather or great-grandfather by birth. It is an undivided property from four generations which is inherited. If any other relations inherit a property, then it is not considered as an ancestral property.
In this video legal expart Adv Papia (Decode The Law) discussed about that landmark judgement of Hon'ble Supreme Court related to Property Rights of Daughters in India. I will encourage you to watch this video till the end to know more about this topic
A daughter can acquire, hold, and dispose of, Property at par with any other man. Today, there are practically no restrictions on a woman's capacity to acquire, hold, and dispose of, her Property. Daughters have an equal share in their father's self-acquired Property as well as ancestral property.
In Vineeta Sharma (supra) the Apex Court had said that daughter shall remain as coparcener throughout life, regardless of the question as to whether her father was alive when the law was amended in 2005 or not, stressing that the law has a retrospective effect.
