What should you expect for your discovery deposition in your car accident personal injury case? Your discovery deposition is one of the most, if not the most, critical event of the litigation of your car accident personal injury case; and goes a very long way in determining whether your personal injury claim will be settled pretrial or will be tried in court in front of a judge or jury.
At your car accident deposition you're going to be answering questions under oath under the penalties of perjury as if you were testifying in court. And you're going to be primarily asked questions by the at-fault driver's insurance company's lawyer. It is critical that you keep a calm demeanor. You only answer the question asked, and you be as brief as possible with your answers.
Assuming that you have gone over the process with your lawyer and you've had several preparation sessions with your lawyer, be rest assured you will be fine. Your deposition takes place not in court but in an attorney's office and is a very relaxed environment.
