Welcome to another episode of the criminal justice system. In today's exciting episode we'd be talking about Section 506 of the Pakistan Penal Code, 1860.
506. Punishment for criminal intimidation.--Whoever commits the offence of criminal intimidation shall be punished with imprisonment of either description for a term which may extend to two years, or with fine or with both.
If threat be to cause death or grievous hurt, etc.-And if the threat be to cause death or grievous hurt, or to cause the destruction of any property by fire, or to cause an offence punishable with death or imprisonment for life, or with imprisonment for a term which may extend to seven years, or to impute unchastity to a woman, shall be punished with imprisonment of either description for a term which may extend to seven years, or with fine, or with both.
1. Scope. Complaint. A counter blast against civil suit. 1990 PCr.LJ 876.
2. Bail. In the instant case, the petitioner had not fulfilled the undertaking given in the High Court not only once but thrice. Even otherwise, no one could claim bail as of right in non-bailable offences even though the same did not fall within the prohibitory clause. Bail after arrest refused. 2006 P.Cr.R. 181.
3. Appreciation of evidence. Applicant punished under Sections 120/121 of Railway Act and 506 Penal Code, 1860. Appellate Court reduced sentence from 6 months R.I, awarded under Sections 506 PPC and 353 PPC to two months with benefits of S. 382-B Cr.P.C. Appellant is a trade-union activist and it is not unlikely that he interfered with the working of a public servant in discharge of his official duty. He has already remained 37 days behind bar and is facing trial and prosecution for the last 6 years such as mitigating circumstances to reduce sentence from 2 months to the extent already undergone.
