Many will have taken advantage of the cost effective EU-wide system for protecting their trade marks and designs. For new rights after 1 January, however, brand owners will need to file separate applications – in both the UK and the EU. But, the package of measures in the Brexit Withdrawal Agreement avoids disruption for rights owners in relation to their existing portfolios. EU trade mark and design registrations will be preserved in the UK through the automatic creation, free of charge, of a UK right. Overnight, the UK trade marks register will treble in size, with around 1.4m EU trade marks being cloned into UK rights.
