You realize you cannot handle this on your own and need an attorney to help you.
Being a world-class negotiator, you feel you can easily find the best attorney to represent you while you negotiate a lower fee.
You believe that every attorney you talk to will eagerly want to handle your case even in light of your demand to reduce their fee.
What you may not know is that an attorney's fee, especially in a medical malpractice case here in New York, is set by law.
Attorneys in New York who handle these types of accident and medical malpractice matters ONLY get paid after spending hundreds and thousands of hours of their time to prosecute your matter. They ONLY get paid if they are successful and get you a result.
An attorney invests all of his own money to prosecute your case from start to finish, with the expectation that if he is successful, he would then receive a percentage whatever he recovers for you.
The alternative to that, which by the way is known as a contingency fee, is to hire an attorney on an hourly basis.
Contingency fees came about because many injured victims simply did not have the financial resources needed to pay an excellent attorney his hourly fees.
Your negotiating skills may be on par with the attorney you are considering hiring. You may even be better.
But, what you don't know is that most really good experienced trial attorneys will not negotiate their fee.
