Several plaintiffs sued NBC, Man Handel, and Fred Francis for defamation, misrepresentation, negligent infliction of emotional distress, invasion of privacy, and loss of consortium based on a "Dateline NBC" television program about tired long-distance truck drivers. The court found that the defendants were not liable for defamation, but liable for misrepresentation to one of the plaintiffs. The court also overturned the invasion of privacy judgment, but allowed for further proceedings on a loss of consortium claim. The plaintiffs' request for punitive damages was denied due to insufficient evidence of common-law malice.
