Hall was an experienced ski instructor. He was skiing very quickly, without control or skill, and flew off a knoll. He hit Cobb, who sustained a brain injury and died as a result. He was charged with reckless manslaughter, but the trial court threw out the charges on the grounds that he did not act recklessly. The facility had only had 2 deaths in eleven years of operation, a period during which over 17 million people had visited. So, the trial court reasoned, there was 50% or less probability that his conduct would cause death.
