This is Omaha and Lincoln Nebraska Bankruptcy Attorney Burke Smith answering the question “How quickly can I stop my wages from being garnished?" The answer is immediately, if you're going to be filing bankruptcy. The magic of the bankruptcy process is that as soon as you ask for protection under the Bankruptcy Code, you get it. As soon as you file your bankruptcy petition something comes into effect that protects you in your property and that’s called the “Automatic Stay”. As soon as your bankruptcy case is filed all attempts to take money or property from you are immediately prohibited.
 
I've had clients who are having their wages garnished from a lawsuit from a debt collector or medical bills or a repossessed car and one example in one instance my client had been garnished was getting 25% of her income taken from her paycheck. She couldn't afford food, she was having a hard time paying for rent and as soon as we filed her bankruptcy petition the garnishment stopped. We contact the employer and the lawyers who on the other side who were garnishing her wages let them know that she has filed bankruptcy and upon doing so garnishment ceases and all of a sudden she's back to her normal paycheck. And food on the table for the kids, rent being paid. Life is a lot easier after that garnishment has stopped.
