Instagram & Fair Use Law Explained: How the MASHABLE Copyright lawsuit effects Photographers
As you may have heard, Mashable has recently won a lawsuit brought against them by National Geographic Photographer and Photojournalist Stephanie Sinclair regarding the use of one of her photos made public via an Instagram post that was embedded in a Mashable article.
Today I wanted to discuss why I believe Mashable won this lawsuit and it had to with Section 107 of copyright law regarding fair use. In this case Mashable’s use of the embedded post falls under “editorial” use as the article in question was about female photojournalists and Sinclair was one of the photographers being mentioned.
