Did you know you can be charged with fifth degree assault in Minnesota without ever touching someone? Minnesota has two forms of misdemeanor assault in the 5th degree: assault "harm" and assault "fear". This video is about fifth degree misdemeanor assault "fear." The statute is 609.224 subd. 1(1). The law says that whoever commits an act WITH INTENT to cause fear in another of immediate bodily harm or death is guilty of a misdemeanor. In Minnesota, that means a maximum of 90 days in jail and a $1,000 fine. Besides risking jail and two years of probation, there are other consequences that make it worth hiring an experienced lawyer. If you plead guilty or are found guilty of misdemeanor assault, you may lose your job or turned down from other job opportunities.
