If My Case Gets Dismissed, Does My Charge Automatically Come Off My Criminal Record?
I get this question at least 2-3x per week. We get many dismissals for our clients and they hear rumors from friends another people that if they were exonerated, the arrest should immediately come off their record automatically. Unfortunately, that is not true. It does not work that way. It is so important that we understand the rules for how someone is able to get their criminal arrest off their criminal record. The rules for how quickly you can get an arrest off of your record depend greatly upon the type of charge you have and how it was dismissed.
For instance, if your case was a felony and it was No Billed by the grand jury, you would have to wait 3 years from the date of the No Bill until the case would be eligible for an expunction. What if it was a misdemeanor? Misdemeanor crimes in Texas that are dismissed must wait 2 years under the law for an expunction. What if your Class A or B Misdemeanor was dropped to a Class C Ticket Deferred and later dismissed? Under that scenario, you would also have to wait 2 years from the date of the dismissal before you could get the arrest expunged from your record. Finally, if the case had been resolved under a Diversion Program, you might be eligible to get the arrest expunged from your record as soon as you complete the program.
