In this case, the defendant, Brown, intentionally crashed a car that he believed he had the right to use. The complainant claims that the car was gifted to her, while Brown argues that they had an informal agreement to share its use. Brown cannot be convicted of larceny because he believed he had a right to use the car. However, he is guilty of criminal mischief because he intentionally damaged the complainant's property without the right or reasonable belief that he had such a right.
