Initially, the attorney is concerned about how serious the potential client's injuries are because if they are relatively minor, the injured party may not need to hire an attorney at all.
If they are of a continuing nature, the attorney should assure that the client obtains adequate medical care. Insurance polices and public sources of potential treatment should be identified. If necessary, the attorney may discuss and arrange treatment on a lien.
If the injuries disable the client from work, sources of replacement earnings such as unemployment insurance or SSDI should be discussed.
Finally, the attorney should review the potential doctors that are continuing treatment.
An experienced attorney will know the reputation and ability of many doctors in the area. If the doctor is below par or, alternatively, is a competent Dr who is afraid to go to court, the attorney needs to explain that to his client.
Sitting back and allowing clients to treat with below par or cowardly doctors is one of the worst mistakes a personal injury attorney can make.
