UPDATES March 16, 2020 from AILA:
USCIS NYC Field Office: While members have reported receiving calls about interviews being cancelled, this is by no means official policy. In fact, we can not verify that the phone calls are actually from USCIS. Unfortunately, we are still waiting to hear back from the local office, who had previously informed us that would be meeting today. Until we hear otherwise, plan on interviews going forward tomorrow. USCIS is, however, advising applicants that if they or their representatives are not feeling well they should reschedule their cases. Interviews should be rescheduled on the E-request function on uscis.gov. An attachment was included in my email from yesterday as well as Sylvie’s 3/11/20 email. You can also contact the 800 375 5283 to reschedule.
National Policy For All Asylum Offices: Affirmative asylum interviews are proceeding as scheduled. Decision pick-up appointments are cancelled; all decisions will be mailed. Asylum offices will not accept walk-in inquiries. Asylum offices will not accept supplementary documents in person except at the time of the interview. Any documents sent in advance must be sent by mail or courier. (N.B. the Newark Asylum Office normally requires documents one week before the interview date; this requirement has not changed, but the documents may not be delivered in person. The New York Asylum Office will accept documents at the time of the interview and the prohibition on in-person filings applies only to dropping off documents in advance).
ICE-NY Field Office: Until the close of business on April 14, 2020, all reporting requirements of non-detained individuals have been suspended, and all appointments to report in person to ERO New York City, or any sub-offices (Central Islip and Newburgh) as well as to report in person to contractors (BI) on ATD have been cancelled, and will be rescheduled. Telephonic reporting, has not been been suspended.
ICE Facilities: Legal Visitation should be permitted to continue under certain conditions. This, like everything, is subject to change.
CBP: Individuals admitted under the VWP/ESTA program who find themselves unable to depart the U.S, before their current period of admission will end because of COVID-19 related issues who were admitted to the U.S. through John F. Kennedy International Airport, NY (JFK) and Newark Liberty International Airport, NJ (only) can contact the Deferred Inspections office at JFK, starting Monday, March 16, 2020, Monday – Friday, 9am to 4pm ET and request Satisfactory Departure for up to 30 days. Individuals or their attorneys will need to provide the affected individual’s name, Date of Birth (DOB) and passport information at the time of the request. Individuals and their attorneys may be asked to provide the original departure flight itinerary along with the new flight itinerary. Please see Kushal’s 3/15/20 email for further details (Subject: Requesting Satisfactory Departure. For Admissions at JFK & Newark ONLY)
EOIR-ALL COURTS THROUGHOUT THE U.S. All non detained master calendar hearings are postponed. Respondents or their representatives, as applicable, who are affected will receive notice of their new hearing date at least 10 days before the new date. All filings will be accepted under usual operations. Detained masters and all individual hearings are moving forward. Unless otherwise informed, this information is accurate through April 10.
