Arraignment is the first step in your DUI case. It means your case is official filed with the court and is ready to proceed. At arraignemnt you will official enter you plea and file any motions if you do not resolve your case. You do not have to go in front of the judge on this date as most judges will allow your lawyer to enter a not guilty plea on your behalf. If your case is in a muniicpal court the arraignment is often the first chance your lawyer has to discuss the case with the prosecutor. Remeber, you always have the chance to move your case from a municipal court to the State court for a jury trial. If your lawyer needs additional time to discuss the case in a city or municipal court the arraignemnt date can be continued before you have to request a jury trial. You are required to file motions within 10 days of arraigment. Often times your lawywer may not have all the information needed to decide which motions are apporpriate in your case so they file template or boilerplate motions with the ability to amend them in the future. You do not want to file a bunch of motions that you have zero chance of wining because a judge may stop paying attention on the issues that can win your case or get upset you are wasting his time. There is nothing wrong with filing a motion and losing but frivilous matters are never going to win your case.
