Attorney Tom Olsen: Now, colonel, another thing about people often call our office and I think they sound a bit surprised, and the basic question is, “Hey, if I don't pay my mortgage company, can my mortgage company kick me out of my house?” How would you respond to a caller like that?
Attorney Colonel Airth: Well I'll first tell them that yes, they can unfortunately kick you out of your house, however, it is certainly not quick and it take a long, long time, and in the United States we have what is called due process, and in Florida the due process includes a foreclosure suit being filed against you, you being served, you have an opportunity to file an answer, you have an opportunity to try for mediation, for instance to modify during the process, but if they go all the way through the process for instance for you to fault and you don't file an answer to your law suit or if the situation is -- perhaps you be moved, you don't even care about the house anymore.
But the bottom line is once a set of foreclosure judgment gets entered, the sale occurs, 10 days later the certificate of title is issued to some whoever bought it at the foreclosure sale, and that person has arrived after 24 hours to get a writ of possession, that writ of possession then is brought to your house, usually an actual copy of this taped on the door, that's called, that's the highest get served, 24 hours after that, the sheriff or deputy sheriff and the plaintiff and usually some workers come to your house, they can forcibly break into your house, they take any personal property and possessions out of the house and put them on a curb, if you're in there, they physically evict you and let in the new owner into possession of the house, so in that sense of the word, they can kick you out, but it's as I've noted, it takes a while and certainly not quick.
