Trivedi v. Cooper | 1996 U.S. Dist. LEXIS 18715 (1996)
The Federal Rules of Civil Procedure provide several ways for parties to challenge a jury’s verdict. Trivedi versus Cooper explained how to analyze different post-trial motions.
Vipin Trivedi, a research scientist at the New York State Office of Mental Health, sued his supervisor, Thomas Cooper, in New York City’s federal district court, alleging employment discrimination based on his race or national origin. Trivedi, who was of East Asian Indian descent, asserted that Cooper had harassed him, failed to promote him, and retaliated against him.
At trial, Trivedi claimed that Cooper had harmed Trivedi’s professional development in numerous ways, including refusing to sponsor him for a promotion. Trivedi also alleged that Cooper had repeatedly referred to Trivedi using racial slurs, though Trivedi couldn’t identify anyone who’d witnessed it. Trivedi further asserted that Cooper gave him a poor performance evaluation after learning that Trivedi had requested legal assistance for his employment-discrimination claim. Trivedi testified that the alleged discrimination made him feel insulted and sad.
Cooper denied Trivedi’s allegations of misconduct. He also introduced evidence and expert psychiatric testimony to show that Trivedi was mentally ill and had experienced paranoid delusions that Cooper was harassing him. Trivedi didn’t present any psychiatric evidence to rebut the experts’ testimony. The court denied Cooper’s motion for a directed verdict.
The jury ultimately found for Trivedi, concluding that Cooper had created a hostile work environment, failed to promote Trivedi, and retaliated against him. The jury awarded Trivedi damages, including seven hundred thousand dollars for emotional distress on his hostile-work-environment claim. Cooper moved for judgment as a matter of law, for a new trial, or for remittitur.
