The Supreme Court has ruled that carers who on sleep-in shifts, in a care home or a private individual’s home, are not entitled to be paid minimum wage when they’re on their sleep-in shift.
It doesn’t mean people on ‘sleep-in’ shifts aren’t ‘working’; after all, they’re not there as volunteers; they’re there to be available if needed. But they’re not ‘working’ for the purpose of the minimum wage rules, unless they’re both awake and doing work for the employer.
The law on this needs changing. Some of the most undervalued and poorest paid members of society are not being properly protected. We know care homes struggle for funds. But something needs to change.
