What is Form GST DRC-03?
DRC-03 is a form under the GST law that is required to be filed for voluntary tax payments towards demand or tax shortfall noticed later after the time limit to file returns of a financial year expires.
What is Payment on Voluntary Basis?
The facility of Payment on Voluntary Basis is given to taxpayers to make payment u/s 73 or 74 of the CGST Act, 2017 within 30 days of issuance of Show Cause Notice (SCN). Payment could also be made by taxpayers before SCN is issued.
What are the Causes of Making Payment Under DRC-03?
1. Audit/Reconciliation Statement: Errors identified during a GST audit or reconciliation.
2. Investigation & Others: Payment due to a GST investigation or other reasons.
3. Annual Return: Discrepancies found while filing the annual GST return.
4. Demand or in response to show cause notice: Payment made in response to a GST demand notice or show cause notice.
5. Liability Mismatch – GSTR-1 to GSTR-3B: Tax difference between GSTR-1 (outward supply) and GSTR-3B (tax liability).
6. ITC Mismatch: Difference in Input Tax Credit (ITC) claimed in GSTR-2A/2B and GSTR-3B.
What is the Process to Make Voluntary Payment?
The process to make voluntary payment:
1. Navigate to Services
2. Go to User Services
3. Click on My Applications
4. Go to Intimation of Voluntary Payment - DRC - 03 option.
Prerequisites:
a. In case, voluntary payment is made before issue of SCN.
• Show Cause Notice under determination of tax should not have been issued.
b. In case, voluntary payment is made after issue of SCN or statement.
• 30 days’ time has not lapsed since SCN is issued.
