The defendant was convicted of burglary and sentenced to three to seven years in prison for stealing two parcels from his company's freight warehouse. The only question raised was whether the information charging the defendant with burglary with force was supported by evidence that he entered using a key provided by the owner. The court must determine if the evidence supports the charge, which would elevate the crime from petit larceny to burglary, carrying a more serious punishment.
