The case involves two citizen suits against the City of Dallas and the Executive Director of the Texas Natural Resource Conservation Commission for violating the Resource Conservation and Recovery Act. The City allowed contractors to illegally dispose of hazardous debris at the Deepwood dump, which is next to residential neighborhoods and a tributary to the Trinity River. The district court granted injunctive relief against the City and denied injunctive relief against the Executive Director. The most relevant facts are that the City was found liable for its negligent oversight of waste disposal and that the plaintiffs failed to prove that the Executive Director violated the statutory provisions and regulations that are the basis of their suit against him.
