Unfortunately, accidents and sometimes deaths can occur on your property.
The amazon delivery driver who was killed by dogs, and the dogs who were then killed by police was a huge tragedy no matter how you look at it. It was an unfortunate event that ended terribly.
What should you do as a homeowner to prevent this from happening?
Are you responsible for injuries or deaths on your property?
It depends on what you did to prevent it from happening in the first place.
Taking a few simple steps like restraining your dogs or any potentially violent pets. This is especially important if you’re not at home or out of town for a few days. Don’t let them run loose in the yard without supervision. Get someone to watch them or take them to a petsitter.
It’s your responsibility as a homeowner or even as a tenant to prevent any injuries or deaths from occurring if you own any potentially dangerous pets. Sure, your pet may not have meant any harm, but intending to cause harm is not the point. The actual act of causing the injury or harm is what courts will look at to determine liability.
As a property owner, you have a duty of care to people you invite onto your property—this includes delivery drivers!!!
If you know there’s a potentially dangerous condition on your property like a big hole, loose stairs, a slippery deck, or a dog who get startled and wants to protect its home, you have a duty to protect the public from injuries. This means you have to WARN the public of potential dangerous and prevent injuries from occurring.
A few simple warning signs that are obvious from all angles can help, or better yet, fixing the actual issue would be more helpful.
