Brown v. Texas | 443 U.S. 47 (1979)
The Fourth Amendment prohibits unreasonable government searches and seizures. Is it reasonable for the police to detain someone in a high crime area just to find out who he is? That’s the question in Brown versus Texas.
One afternoon, two police officers observed Zackary Brown and another man walking away from each other in opposite directions in an alley. The alley was in a part of the city known for drug trafficking. Although the officers didn’t see Brown and the other man together, the officers believed that Brown and the other man had been together or had been about to meet until they spotted the police cruiser.
The officers stopped Brown and asked him to identify himself. The officers didn’t suspect Brown of any particular wrongdoing and had no reason to think he had a weapon. They stopped Brown because they hadn’t seen him in that area before and thought he looked suspicious. Brown refused to identify himself. The officers arrested Brown for violating a Texas statute that criminalizes a person’s refusal to give his name and address to a police officer who has lawfully stopped him and requested the information.
At his trial in state court, Brown waived his right to a jury and moved to dismiss the charges, arguing that the statute was unconstitutional. The trial court convicted Brown and fined him $45. Texas law didn’t allow Brown an appeal because his fine was less than $100. Brown therefore appealed directly to the United States Supreme Court.
