It's wintertime here in New York.
We just had a large snowstorm.
It was a blizzard.
It dumped lots of snow.
The next day it was beautiful and much of the snow started to melt.
That evening, temperatures dropped and that water runoff froze.
That created a thin, transparent sheet of ice often referred to as “black ice.”
When you slip on ice and fall and suffer significant injury, one of the first questions that will arise is “Who is responsible for not clearing the ice?”
Another question you need to ask in your search for whether someone is legally responsible for your injuries is “Am I also partially at fault for my own accident?”
Even if you don't ask this question of yourself internally, if you bring a lawsuit seeking compensation for the injuries you suffered when you slipped and fell, the defense will most certainly claim that you are partially at fault if not totally at fault for your own injuries.
The defense will argue that you should have been looking where you were going. They will make the claim that had you bothered to look up from your phone or stop texting, you would have easily seen the dangerous condition that you slipped on.
Slipping and falling on black ice is not fun.
Especially when you suffer significant injury that requires a trip to the hospital with emergency surgery and rehabilitation.
An experienced attorney will want to know every detail about what happened in order to determine not just whether the property owner was responsible for not clearing the ice on his property but whether you may also be partially at fault.
