In her defense, Phoon has argued that she was not wearing a mask because she was sucking on lozenges and that she wear a mask 39 seconds later. Point to note is she mentioned exactly 39 seconds later. However, the 24 CCTV footage and played in court showed Phoon not wearing a mask while walking around at the time of the alleged offenses. Phoon also claims that the CCTV footages can be edited to add "additional figures". It is important to note that during that period in time, the government had a legitimate interest in protecting public health, and this interest outweighs Phoon's individual right to choose whether or not to wear a mask.
