The Sixth Amendment to the United States Constitution ensures that criminal defendants have the right to a speedy trial by an impartial jury. But what if a person doesn’t want a trial by jury? In Singer versus United States, the Supreme Court answers whether a person can choose to have a bench trial and waive his or her constitutional right to a trial by jury.
Mortimer Singer was charged with thirty counts of mail fraud in federal court for a scheme where he pretended to be a music executive to defraud amateur songwriters. At Singer’s first trial, he waived his right to a jury trial to help shorten the length of the trial. Singer cited Rule Twenty-Three A of the Federal Rules of Criminal Procedure, which permits a defendant to waive his or her right to a jury trial, as long as the court approves and the government gives its consent to the waiver. The district court was willing to accept Singer’s waiver, but the government refused to consent to the waiver.
Singer was convicted by a jury and appealed to the Court of Appeals for the Ninth Circuit, claiming that he was entitled to waive his right to a jury trial. The court of appeals affirmed the trial court’s ruling and held that Singer couldn’t waive his right to a jury trial. The United States Supreme Court granted cert.
