The FTC held its first pretrial conference in its lawsuit to block the Microsoft Activision Blizzard deal. We'll watch the highlights from that conference and I’ll share some of my initial thoughts.
Last month the FTC sued to block Microsoft’s $68.7 billion acquisition of game developer Activision Blizzard. The next day, the FTC's Administrative Law Judge assigned to this case ordered a scheduling conference.
On January 3, the Court held its scheduling conference by telephone. The FTC posted a phone number on its website that people could call if they wanted to listen to the conference call. Apparently, there were many more callers than expected.
A scheduling conference occurs at the start of a lawsuit. The parties do not argue the merits of the case or present evidence. Instead, it’s an opportunity for the judge and the attorneys to look at their calendars and agree on deadlines for completing discovery and filing motions.
During this scheduling conference, the lawyers for the FTC and Microsoft answered questions about the existence of parallel proceedings, settlement negotiations, and the scheduling order.
