US Xpress Enterprises is back and winning. In a case that was appealed from a summary judgement, US Xpress trucking does not have to pay minimum wage to drivers for non-productive time, meaning time spent on tasks like fueling, waiting and other non-driving things. I kind of knew this would happen. All you are really entitled to is minimum wage for the entirety of your work week. For Federal minimum wage that is just over $616 for 70 hours including overtime. That is nothing to fight for. If a driver feels that they are not being compensated properly for their time at US Xpress or any other company they should quit and go somewhere else. If people did that companies that are constantly taken to task for this could not find workers and would be forced to pay or go out of business. Unfortunately, that doesn't happen and there is a steady stream of people willing to work for free. US Xpress has absolutely no incentive to change its pay as long as people accept the pay they currently have.
