In a big development in the case pertaining to the Prevention of Money Laundering Act, which grants sweeping powers to the Enforcement Directorate, the Chief Justice of India N.V Ramana observed that two aspects of the court's previous verdict need to be reconsidered. One is that which puts the burden of proof on the accused, and the other is of not providing case documents, or the ECIR copy, to the accused. The court further stated that while it is in full support of preventing black money, these two aspects particularly need a relook. Do 'unchecked' powers embolden probe agencies? Can the Supreme Court 'restore' the ED's 'credibility'? What can be done to ensure the 'independence' of probe agencies? We discuss it all on the India Development Debate with Sanjay Hegde, Senior Advocate, Supreme Court, Ashish Chandra Singh, former Deputy Legal Advisor, ED and Bharat Chugh, Advocate, Supreme Court.
