Laura Noble, the founder of the employment law firm The Noble Law, answers the question: can you be fired for what you post on social media?
An employer is not bound by the first amendment, so they can restrict the kind of speech that it finds acceptable in the workplace. However, there are some exceptions. For example, you cannot be fired for complaining about working conditions. Public employees have due process hearings, and the rules may be different depending on your employment contract.
If the company can determine that your speech is offensive or in some way demonstrates that you are no longer the right fit for their company values or culture, they can terminate you for that free speech that you made on social media.
