Massachusetts has what's called a lifetime lookback for OUIs. So Damian was facing a second offense, the possibility of jail time, up to a five-year license loss, thousands of dollars in fines, and a mandatory inpatient two-week alcohol treatment program.

At Marlborough District Court did in Middlesex County, Joe stressed to the jury that Damian had no trouble producing his license and no trouble producing his registration, meaning his fine motor skills were normal. Joe also got the police officer to admit that Damian had no trouble exiting the car and walking over to the testing area.
As a result, Joe convinced the jury to acquit Damian of second offense drunk driving.
