If you’re paid by 1099, that generally means that you’re an independent contractor. If you’re a legitimate independent contractor, then you cannot receive unemployment benefits. Now, If you’re getting to the point where you’re seeking unemployment benefits because of your relationship with a particular employer, it may be that they’ve miss classified you as an independent contractor when you’re truly an employee. In those cases, the unemployment commission might investigate that relationship and determine whether you’re really an independent contractor or an employee.
