DEFECTIVE SIDEWALK ACCIDENTS:
The sidewalks of New York City are far too frequently poorly maintained. Broken uneven sidewalks pose a significant risk of injury. Section 7-210 of the City of New York Administrative Code requires certain types properties to maintain the abutting sidewalks.
REQUIREMENTS OF PROOF IN DEFECTIVE SIDEWALK CASES:
In defective sidewalk case, we must prove that there was an unreasonably dangerous condition that was a cause of your accident.
We also must prove that the condition was either caused and created by the defendant or that the condition was in existence for too long before the accident that in the exercise of reasonable care, it should have been recognized and remedied before the accident. For this reason, photos of the defective condition taken shortly after the accident are critical.
TYPES OF DEFECTIVE SIDEWALK CONDITIONS:
In New York City there are many type of defective sidewalk conditions that can cause serious injury. Raised or sunken flagstones, broken sections of sidewalk, holes in the sidewalk, curbs that are uneven with the sidewalk; tree roots that have expanded underneath and have created a tripping hazard on the sidewalk.
DEFECTIVE HARDWARE EMBEDDED IN THE SIDEWALK:
There are also trip and fall hazards as a result of failing to maintain certain types of hardware embedded into the sidewalks, such as gas caps, gratings, cellar doors and old sign posts.
Section 2-07 of the Rules and Regulations of the City of New York require owner of covers and gratings to monitor their condition and maintain the area extending twelve inches outward from the perimeter of the cover or grating. This same provision also requires the hardware to be flush with the sidewalk or roadway. Hardware that extends greater than ½ inch above or below the street surface is an unreasonably dangerous condition defined by statute.
