In a recent ruling, the Supreme Court affirmed that Stridhan, which includes gifts given to a wife at the time of marriage, remains her exclusive property. The court emphasized that a husband has no authority over Stridhan and is morally obligated to return it to his wife, even if he uses it during times of distress. The case, Maya Gopinath versus Anoop SB, highlighted the importance of recognizing Stridhan as the wife's absolute property, and the husband's responsibility to restore it. Supreme court also directed a former husband to pay Rs 25 lakh to his wife as compensation for her lost gold, reaffirming the principle that Stridhan does not become joint property and remains under the wife's ownership.
DEFINITION- Stridhan refers to gifts given to a bride by her husband, parents, or her husband's relatives during or around her wedding. These gifts, whether given before, during, or after the wedding, belong solely to the bride. She can do whatever she wants with them because they are her own property. Even though a husband might use these gifts during tough times, he should give them back or their worth to his wife later. This means that Stridhan isn't shared between husband and wife, and the husband doesn't have control or ownership rights over these gifts.
