We are the leading legal practice specialising exclusively in police caution removal and DBS appeals.
We have years of experience and have had hundreds of cautions removed from the Police National Computer.
If you have received a police caution then it may only be now, sometime after you have left the police station, that you are realising the impact a police caution may have on your future.
The police may have told you the police caution was a “slap on the wrist”, that it wouldn’t harm your future, or that it would completely disappear after a few years.
It might be the case that you were afraid of being taken to Court.
Perhaps you were afraid if you didn’t accept the police caution things would get much worse.
You might even have felt under pressure or you were intimidated by the police which resulted in you confessing to something you didn’t do.
If you plan to or currently work in a regulated sector then you may find that having a police caution on your record will have very serious implications on your future work. If you work, or wish to work in a regulated environment, then you will usually have to undergo a standard or an enhanced Disclosure and Barring Service (DBS) background check. If you work in finance, law, healthcare, teaching, social work, IT forensics, accountancy or another regulated profession the caution may need to be disclosed to your regulator and could result in disciplinary proceedings.
A caution can also impact voluntary work, including volunteering at your children’s school, adoption, fostering and any other role related to close contact with children or vulnerable adults.
A caution, particularly if it is for, a violence, neglect, or sex related offence, can also trigger DBS barring proceedings. If you are placed on the barred lists, you will be prevented from working with children or vulnerable adults.
A police caution can also cause significant problems when it comes to overseas travel, particularly when it comes to long term visas and citizenship applications. If you have a police caution it will be retained on the Police National Computer (PNC) until you reach 100 years of age, unless it is deleted.
A caution will also be revealed on an ACRO Police Certificate for either 5 or 10 years, depending on the type of offence; thereafter it will be indirectly revealed as “No Live Trace”. An Acro police certificate is typically required when applying for an overseas visa or citizenship.
If you present a “No Live Trace” certificate when undertaking an immigration application, often you will be asked to provide a complete copy of your criminal record. Certain countries can be very strict when it comes to any former criminal record. Police cautions for certain offences can make you ineligible for a Visa or citizenship.
If you are experiencing any of these problems, it is possible to get a police caution removed from your record, depending on the facts of your case.
It may be the case that you were incorrectly advised to accept a police caution or you were unfit to accept the caution at the time.
The police are required to follow a defined procedure at the police station – if they have not properly followed this procedure, to the extent that it has made your caution unfair, your caution may be eligible for deletion. There may also be other factors in your case that mean the police will agree to remove your caution.
Through the preparation of hundreds of deletion cases we are well placed to able to determine whether a case is likely to succeed or not.
This is not just based on our extensive knowledge of the law, but also based on our knowledge of particular police forces, how they have reacted in the past, and our previous successful cases.
We believe we are the legal practice with the most experience of police record deletion in the country.
It is due to this extensive knowledge and experience that we have become known as the go-to legal practice for any criminal record or DBS issue.
Although we believe it is best that you instruct an experienced police caution deletion solicitor, we understand that costs can be an issue.
If you do want an experienced lawyer to represent you, we offer reasonable fixed fees – and you will know all our costs up front, and we will not go over this limit.
Some more complex cases may require a slightly higher fixed fee, whereas for more straightforward cases the costs may be lower.
In all cases we offer a fixed fee initial consultation where you will get expert legal advice (and a sympathetic ear) followed up by a detailed written advice with clearly explained costs.
If you would like to set up an initial consultation, and to discuss our costs for police caution removal, then please get in touch.
