Watch this video to learn your legal rights if you get pulled over by the police in New Jersey.
If you're pulled over in the state of New Jersey, the police have certain protocols that they go through and you have certain rights as well. Sometimes, that line gets a little murky. Obviously, the police officer can ask you for your license, registration, and insurance. A lot of people don't realize that a police officer in the state of New Jersey can also ask you, legitimately, to get out of your car. If you don't, you could be subject to obstructing justice or a disorderly person offense for disobeying a police officer. I have seen that situation actually escalate, unfortunately, into a much more complicated criminal matter when people refuse to get out of a car.
Ordinarily, in the state of New Jersey, the police officer won't ask you to get out of the car unless they're looking to test you for a DUI or some type of driving while intoxicated charge. They might want to search you, pat you down, or see how you react to their questions. Very often, if they think that there are drugs in the car and there's a passenger, they might want to speak to you separately, or have another officer come and speak to one of you, and then separate you and speak to the other and compare your stories to see if they can find a way to have probable cause or to put pressure on you to search your vehicle. Remember, you always have the right to deny them access to your vehicle and you do not have to consent to the search of your vehicle.
