The Supreme Court was asked to interpret an ouster clause – a clause designed to prevent judicial review over decisions of the Investigatory Powers Tribunal which oversees the operations of national security agencies. Professor Young sets out the different views of the majority and dissenting judges and explains why some see this is a controversial constitutional case.
