Watts v. Indiana | 338 U.S. 49 (1949)

What can the police do to elicit a confession from a suspect? Officers interrogate a suspect for five days in Watts versus Indiana.

Robert Watts was arrested on suspicion of criminal assault. Soon afterward, a body was discovered near where Watts was arrested that appeared to be another criminal-assault victim. Suspicion quickly turned to Watts, who was taken to state police headquarters. There, he was kept in solitary confinement and sometimes driven around town in an attempt to elicit a confession. Watts was questioned by six to eight officers in shifts from about 11:30 at night to between 2:30 and 3:00 the following morning. The same interrogation procedure was expanded and continued for the next five days, although Watts wasn’t interrogated on the Sunday he was in custody. Watts eventually confessed after a day of nine hours of continuous questioning. During his confinement, Watts was deprived of sleep, adequate food, legal counsel, and a preliminary hearing. He also was never advised of his constitutional rights.

Watts was eventually convicted of murder. The Indiana Supreme Court upheld the conviction, and Watts appealed to the United States Supreme Court, which granted cert.
