WHAT IS VENUE?

VENUE

The Courthouse that will hear the matter is considered the venue.  The venue is determined by:

(1) Where the Defendant lives at the time the action is filed,
(2) Where the contract was entered into or to be performed,
(3) Where the accident or injury occurred, or
(4) Where the real property in dispute is located.  

It is the responsibility of the Defendant to assert the objection of improper venue.  Federal Courts will consider the convenience of both parties and the witnesses involved in the lawsuit when making a venue transfer.
