When it comes to the topic of internet sexting, it is important for people to know that a 17-year-old person can be arrested for sending a nude picture of themselves to their boyfriend or girlfriend. The bottom line is that sending pictures depicting an underage (under 18 years of age) person who is nude or engaging in a sexual activity is illegal – regardless of the age of the other person involved, and even if both persons are minors. In fact, even discussing sexual acts with someone who is under 18 is a crime of child sexually abusive activity, even when both the offender and the victim are children. Under these circumstances, this crime may not be charged as often as it is when the offender is an adult, but it’s still extremely important to keep in mind, because depending on the circumstances it can, and does, get charged.

The possible penalty for sexting, or child sexually abusive activity in Michigan, is up to 20 years in prison. When charged in conjunction with the use of a computer to commit that crime, the punishment the computer charge can be consecutive to the underlying child sexually abusive activity offense.
