Once Parliament has passed legislation it is for the judiciary to make sense of the provisions in statutes – to interpret or construe the meaning of the words used. The interpretation of statutes is, in fact, a critical function of the judiciary.
The major challenge face by the Judiciary in giving effect to Parliament’s intention is that it is not always a straightforward case in ascertaining the intention of the Parliament by merely looking at the wordings used in an Act of Parliament.
