A recent rule changed The Virgin River's status to a navigable water of the United States placing it and other contributing waters (including ephemeral washes) under the Jurisdiction of the Army Corps. of Engineers.
The change in status has brought hundreds if not thousands of dry washes (ephemeral waters) in Washington County into question as to whether they are under the jurisdiction of the Army Corps. of Engineers. This has created a new challenge for county officials as they look at a new layer of planning that will be involved in road maintenance, adding to costs and the time needed to complete a project.
The Army Corps. points out that they are merely interested in protecting the water and not holding up development. What are the unintended consequences of changing the rules.
