Here in Pennsylvania you have the right to refuse chemical or breath testing, but there are ramifications to that refusal. Refusing a chemical test after an arrest for DUI can result in an automatic license suspension. You can still be prosecuted for the DUI and you'll be prosecuted under a general impairment statute. That means that because they cannot prove your blood alcohol content, your conviction, would be based upon the officer's opinion of your intoxication.
Police officers are trained to form that opinion based upon your driving and their encounter with you. They will take note of whether you were slurring your speech, how your appearance was, and how you answered questions. There are also field sobriety tests that officers are trained to give people suspected of DUI. These are the tests that you may have seen or heard of where you're asked to touch your nose, or walk a straight line heel to toe. Again, officers are trained to see clues that they look for in your performance of those tests to tell if you’re intoxicated. Even if you refuse the blood alcohol testing, you can still be charged and convicted of driving under the influence.
