Can cops search your vehicle if it's within the curtilage (the area directly outside of your home and your garage) of your property?
The case of Collins vs. Virginia answered this question and it's NO! In this case, a police officer tracked down Collins' motorcycle, saw it under a tarp within the curtilage of Collins' home, searched it, and decided to arrest Collins for theft. The Court of Virginia ruled that since the motorcycle was on Collins' curtilage, it was an illegal search, leaving Collins with no theft charge. You have the same Fourth Amendment rights over your curtilage as you do the inside of your home, so your vehicle is protected in this area.
